Oregon Drug Possession Law

Drug possession (or possession of a controlled substance) includes:

  • The physical possession of a controlled substance
  • Having a substance in your immediate control, be it in your home, car, or anywhere else

More than one person can possess the same controlled substance. As a result, two or more people residing in the same household can be charged with drug possession if they are aware of the presence of a drug in their home or another shared space. 

It is important to state that Oregon has decriminalized the possession of many controlled substances in recent years. Measure 110 reclassified numerous offenses as violations, meaning convictions will not result in jail time. 

How Much Marijuana Can You Possess in Oregon?

Since 2015, it has been legal for adults over the age of 21 to possess and use marijuana recreationally in Oregon. However, there are limits to the amounts you can legally possess. According to the law, you can only possess up to eight ounces of marijuana in your residence. Additionally, you can only carry up to one ounce of marijuana on your person at any time. It is illegal for anyone under 21 to have any amount of marijuana.
